Partner Visas

Partner Visa pathways are available for individuals who are in a genuine and committed relationship with either an Australian citizen, Australian permanent resident, or eligible New Zealand citizen.  These visas allow your partner to live in Australia, temporarily at first, transitioning to permanent residency usually after two years.

General Eligibility Requirements

Relationship Status

You must be married to or in a de facto relationship with an eligible sponsor. If married, the marriage must be legally valid under Australian law. Generally, the de facto relationship must have existed for at least 12 months immediately before applying or registered in Australia.

Sponsorship Requirements

Your partner must be an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen. The sponsor generally must be over 18 years of age. There are limitations on how many times a person can sponsor a partner.

Genuine And Continuing Relationship

You must provide evidence that your relationship is genuine and continuing.

Prospective Marriage Visa

Subclass 300

This visa is for people who are engaged to an Australian citizen, permanent resident, or eligible New Zealand citizen and plan to marry them in Australia. You have met your prospective spouse face to face as adults since turning 18 and are known to each other personally at the time you apply for this visa. You must be outside of Australia when you apply for this visa, along with any family that apply with you.

Partner Visa Offshore

Subclass 309 And 100

This visa is for people who are married or in a de facto relationship with an Australian citizen or permanent resident, or eligible New Zealand citizen and apply from outside Australia. This is usually initially a Temporary visa that leads to a further permanent residency Partner visa application after two years together

Make sure of your Sponsors eligibility to sponsor you, and your eligibility to be sponsored. If your case is complex,previous Marriages, children from other relationships, character of health Issues please do not risk a refusal

Partner Visa Onshore

Subclass 820 And 801

This visa is for people who are married or in a de facto relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen and apply from within Australia. This is usually initially a Temporary visa that leads to a further permanent residency Partner visa application after two years together.

Your Sponsor generally can only sponsor you if he/she has not sponsored another person in the last five years. This also applies to you if you have been sponsored before for a Partner visa. There are exemptions to these rules. Always seek professional assistance if unsure.
